Car Share Aus – How Our Service Works (FAQs)

🔹 What does Car Share Aus do?

Car Share Aus provides long-term vehicle hire with an ownership outcome.

You hire a vehicle for an agreed term (usually 1–5 years).
If you complete the full term or pay out early, ownership of the vehicle transfers to you at no extra purchase price.

Until then, the vehicle remains owned by Car Share Aus.

🔹 Is this a loan or finance?

No.

This is not a loan, lease, or finance product.

It is a vehicle hire agreement where:

  • You make rental payments during the term

  • Ownership only transfers at the end (this is called vesting)

🔹 Do my payments build ownership straight away?

Not immediately.

During the agreement:

  • Your payments are rental payments

  • They create an unvested interest, not ownership

Ownership only vests if:

  • You complete the full term, or

  • You pay out the agreement in full, and

  • All amounts owing are cleared

If the agreement ends early, ownership does not vest.

🔹 What is the establishment / down payment?

The establishment payment:

  • Is usually 10%–40% depending on the vehicle and risk

  • Is non-refundable

  • Is not a deposit

  • Does not give ownership or equity on its own

It helps cover risk, setup, and administration.

🔹 Who chooses the vehicle?

You do.

Car Share Aus:

  • Does not operate a traditional fleet

  • Does not choose the vehicle for you

You select the vehicle and dealership and should:

  • Inspect it

  • Test drive it

  • Ensure it suits your needs

We may recommend a dealer for convenience only.

🔹 What condition are the vehicles in?

Vehicles may be:

  • New, or

  • Used with normal wear consistent with age and kilometres

Used vehicles are not “brand new” unless stated.

🔹 Who maintains the vehicle?

You do.

You must:

  • Service the vehicle on time

  • Follow manufacturer requirements

  • Keep service records

Failure to maintain the vehicle can lead to extra costs and loss of protection.

🔹 Can I modify the vehicle?

No — unless you get written approval first.

This includes:

  • Performance modifications

  • Cosmetic changes

  • Wraps, tuning, electronic changes, accessories

Unauthorised modifications are a serious breach.

🔹 Who can drive the vehicle?

Only authorised drivers.

Drivers must:

  • Be at least 21 years old

  • Hold a valid unrestricted licence

  • Not be learner, provisional or probationary drivers

Unauthorised drivers are not allowed.

🔹 Can I use the vehicle for rideshare?

Only if:

  • You get written approval from Car Share Aus first

  • You are registered with an approved rideshare platform

Rideshare without approval is not allowed.

Rideshare has a higher excess.

🔹 What roads or areas are not allowed?

You must not drive the vehicle on:

  • Unsealed or gravel roads

  • Beaches, creeks, rivers or floodwater

  • Snow or ice regions (unless approved)

  • Closed or unsafe roads

  • Offshore islands without approval

Driving in prohibited areas is a breach.

🔹 How does insurance work?

Car Share Aus holds insurance for the Company’s benefit.

You:

  • Are not the policyholder

  • Cannot claim directly on the insurance

Instead, your agreement includes an Accident Liability Contribution (ALC):

  • A contractual contribution

  • Not insurance

  • It may limit what you pay if you follow the rules

If you breach the agreement, ALC may not apply.

🔹 What is the excess?

Excess depends on use:

  • Standard (non-rideshare): $5,000

  • Approved rideshare: $7,500

Additional excesses may apply for:

  • Unlisted drivers

  • Younger drivers

Even in not-at-fault accidents, excess is usually payable unless recovered from the at-fault party.

🔹 What happens if there’s an accident?

You must:

  • Report it within 48 hours

  • Provide photos, details and statements

  • Cooperate fully

Failure to report properly is a serious breach.

🔹 Will I get a replacement vehicle?

Only in not-at-fault accidents, and only if:

  • Liability is confirmed by the insurer’s assessor

If approved:

  • You arrange a like-for-like rental vehicle yourself

  • From a major rental company (e.g. Avis, Hertz, Sixt)

  • You are reimbursed after your vehicle is repaired and returned

No replacement vehicle is provided for at-fault accidents.

🔹 What does “like-for-like” mean?

A similar vehicle type and function, for example:

  • Sedan → Sedan

  • Van → Van

  • Ute → Ute

It does not include:

  • Luxury upgrades

  • Performance vehicles

  • Larger or premium classes

🔹 Can I choose my repairer?

Yes.

You may nominate a repairer, subject to:

  • Insurer approval

  • Licensing and insurance requirements

Repairs depend on parts availability and insurer processes.

🔹 Is roadside assistance included?

We recommend you arrange your own roadside assistance.

Roadside assistance is not guaranteed under the hire or accident process.

🔹 Who pays tolls and fines?

You do.

  • All tolls are your responsibility

  • Unpaid tolls incur admin and recovery fees

  • Traffic fines are transferred to the authorised driver

🔹 What happens if I miss payments?

Missing payments may result in:

  • Late fees

  • Daily charges

  • Interest

  • Immobilisation

  • Repossession (in serious cases)

🔹 What counts as a serious breach?

Examples include:

  • Multiple missed payments

  • Driving unlicensed or intoxicated

  • Tampering with tracking devices

  • Illegal use

  • Unauthorised drivers

  • Leaving Australia without notifying us

Serious breaches can result in termination and repossession.

🔹 What if the vehicle is written off?

If the vehicle is written off:

  1. Any finance or secured liabilities are paid first

  2. Company costs, fees and arrears are recovered

  3. Your payments remain unvested

Any remaining balance may (at our discretion) be credited toward a future vehicle.

🔹 What if I pass away or must leave Australia?

If the Hirer:

  • Passes away

  • Has a visa cancelled

  • Is deported or leaves Australia

The agreement may be terminated and the vehicle repossessed.
A guarantor may be considered to take over, subject to approval.

🔹 How is my personal data used?

We collect and use data to:

  • Manage the agreement

  • Handle claims

  • Comply with the law

  • Recover vehicles if required

This may include sharing information with:

  • Insurers

  • Police

  • Government authorities

  • Toll operators

  • Recovery agents

🔹 What law applies?

Our agreement is governed by New South Wales law.
Your rights under Australian Consumer Law are not excluded.
